1. Aceptación y definiciones

Estos términos regulan el uso de la aplicación Vamos Por Un Café (la "App"), operada por Mendivil Tech ("Mendivil Tech" o "el equipo"). "Usuario" es toda persona que crea una cuenta o usa la App.

Al crear una cuenta, el Usuario acepta estos términos, el Aviso de privacidadPrivacy notice y las Normas de seguridad infantil. Quien no esté de acuerdo no deberá usar la App.

2. Requisitos para usar la App

• El Usuario deberá ser mayor de 18 años.
• El Usuario deberá registrarse con información real, como su nombre, fecha de nacimiento y fotos propias.
• Cada persona podrá tener una sola cuenta, de uso personal, que no podrá compartirse, venderse ni cederse.
• Quien haya sido dado de baja por incumplir estos términos no podrá crear una cuenta nueva.

3. Normas de la comunidad

Para que la App sea un espacio seguro y respetuoso, no se permite:

• Cualquier forma de explotación o abuso sexual infantil (ver las Normas de seguridad infantil). Es causa de baja inmediata y de denuncia ante las autoridades.
• Publicar desnudos o contenido sexual explícito en el perfil, o enviar ese contenido a alguien que no lo pidió.
• Acosar, amenazar, insultar o intimidar a otras personas.
• Hacerse pasar por otra persona o usar fotos que no sean propias.
• Pedir dinero, promover negocios, estafas, esquemas de inversión o servicios sexuales.
• Publicar contenido que promueva el odio o la violencia por origen, género, orientación, religión, discapacidad u otra condición.
• Usar la App para cualquier actividad ilegal.
• Intentar acceder a datos de otros Usuarios, automatizar la App o interferir con su funcionamiento.
• Crear cuentas falsas o usar cuentas de otras personas, incluido para obtener premios o beneficios.

4. Contenido del Usuario

El Usuario conserva la titularidad de las fotos y textos que publica. Al subirlos, autoriza a Mendivil Tech a guardarlos y mostrarlos a otros Usuarios dentro de la App, únicamente para operar el servicio. La autorización termina cuando el Usuario borra el contenido o su cuenta, salvo lo que deba conservarse por un reporte, según el Aviso de privacidad.

Cada Usuario es responsable de lo que publica y de lo que escribe en sus conversaciones.

5. Reportes, moderación y sanciones

• Cualquier Usuario podrá reportar a otro desde su perfil, una foto o una conversación. Al reportar a alguien, también lo bloquea.
• Para acoso, amenazas, estafas, suplantación y cualquier otra conducta grave, el Usuario también podrá escribir a [email protected]. Los casos que involucren a menores de edad se atienden con prioridad urgente.
• Una persona del equipo revisa cada reporte. Mientras se revisa un reporte grave, el equipo podrá ocultar una foto o una cuenta de forma preventiva.
• Según la gravedad, el equipo podrá no tomar ninguna medida, enviar una advertencia, retirar una foto, suspender la cuenta por un tiempo o darla de baja de forma definitiva.
• En casos de posible delito, el equipo conservará la evidencia y podrá entregarla a las autoridades.
• Reportes de mala fe: si se comprueba que un Usuario hizo un reporte falso a sabiendas, para perjudicar a otra persona, podrá ser sancionado con una suspensión o con la baja de su cuenta.
• Apelación: el Usuario sancionado podrá apelar desde la propia App, en la pantalla de su cuenta suspendida o dada de baja, o escribiendo a [email protected] desde el correo de su cuenta. El equipo responderá en un plazo máximo de 10 días hábiles.

6. Seguridad del Usuario

Mendivil Tech no verifica la identidad ni los antecedentes de los Usuarios. Se recomienda tener cuidado al compartir información personal y, al conocer a alguien en persona, hacerlo en un lugar público y avisar a alguien de confianza. Si alguien hace sentir inseguro al Usuario, este deberá reportarlo y bloquearlo.

7. Premium y miembros fundadores

Premium

• Premium es una suscripción opcional y mensual. La App puede usarse sin pagar.
• Incluye: invitaciones a café sin límite, ver a todas las personas que dieron me gusta al Usuario, ver a la gente que está a menos de 20 km y elegir la distancia de búsqueda (de 1 a 100 km), volver a ver el perfil completo de sus matches desde el chat, y usar la App sin anuncios. Mendivil Tech podrá agregar beneficios; si quita alguno, lo avisará antes.
• Precio: en México, $199.99 MXN al mes, IVA incluido. En Estados Unidos, 14.99 USD al mes, más el impuesto sobre ventas que corresponda según el estado, que calcula y cobra la tienda al momento del pago. En otros países, el precio se muestra en la tienda antes de pagar.
• Cobro y renovación: el pago se hace a través de Google Play o App Store, con la forma de pago que el Usuario tenga registrada en la tienda. La suscripción se renueva sola cada mes hasta que el Usuario la cancele desde la sección de suscripciones de la tienda. Al cancelar, el Usuario conserva Premium hasta el final del periodo pagado. Los reembolsos siguen las reglas de la tienda y la ley aplicable.
• Cambios de precio: Mendivil Tech avisará antes de cualquier cambio de precio, y la tienda pedirá la confirmación del Usuario cuando la ley o sus reglas lo exijan.

Miembros fundadores

• Un número limitado de las primeras personas que completan su registro reciben un número de fundador. Ese número es personal y no se muestra a otros Usuarios; los demás solo ven la insignia "Fundador", y solo si el Usuario decide mostrarla.
• Misión de fundador: al reclamar la insignia se abre una misión. Si el Usuario invita con su código a la cantidad de amigos que indique la App (hoy, 10), obtiene un 50% de descuento de por vida en Premium. Cuentan todos los amigos invitados desde su registro, siempre que completen su perfil con foto y sean personas reales. La misión solo podrá cumplirse mientras esté activa; quien ya la cumplió conservará su descuento aunque la misión se cierre.
• 50% de descuento de por vida: quien cumpla la misión pagará la mitad del precio normal de Premium en su país. Hoy son $99.99 MXN al mes, IVA incluido, en México y 7.49 USD al mes, más impuestos, en Estados Unidos. Si el precio normal cambia, su precio seguirá siendo la mitad del nuevo.
• "De por vida" significa mientras exista la cuenta del Usuario y Mendivil Tech ofrezca Premium. El beneficio es personal y no podrá transferirse, venderse ni cederse. Se pierde si el Usuario elimina su cuenta (una cuenta nueva no recupera el número) o si su cuenta se da de baja por incumplir estos términos. Mientras una cuenta esté suspendida, sus beneficios de fundador quedarán en pausa.
• Revisión e irregularidades: el equipo revisa las invitaciones. Cualquier irregularidad, como crear cuentas falsas, usar cuentas de otras personas o pagar por registros, hará que el Usuario pierda automáticamente el beneficio y su insignia de fundador, y podrá dar lugar a la baja de su cuenta.
• Los fundadores también tendrán acceso a temas y funciones exclusivas que Mendivil Tech ofrezca en el futuro. Cuáles y cuándo lo decide Mendivil Tech.
• Fin del programa: el programa de fundadores termina cuando se asignan todos los lugares disponibles o en la fecha que Mendivil Tech anuncie dentro de la App, lo que ocurra primero. Mendivil Tech avisará con al menos 7 días de anticipación a quienes no hayan reclamado su insignia; las insignias que no se reclamen antes del fin ya no podrán reclamarse.

Invitaciones

• Al invitar amigos con su código, el Usuario gana temas para su perfil según la cantidad de amigos que completen su registro.
• Una vez terminado el programa de fundadores, quien complete la invitación de 5 amigos ganará además 1 mes de Premium gratis, que empieza a contar cuando Premium esté disponible.

8. Eliminación de la cuenta

El Usuario podrá eliminar su cuenta en cualquier momento desde la App (Información de la cuenta → Seguridad → Acciones delicadas) o sin la App desde vamosporcafe.com/eliminar-cuenta. Qué se borra y qué se conserva se explica en el Aviso de privacidad. Mendivil Tech también podrá cerrar una cuenta que no respete estos términos.

9. El servicio "tal cual"

La App se ofrece tal como está. Mendivil Tech hace lo posible por que funcione y sea segura, pero no garantiza que no tenga fallas ni que el Usuario vaya a encontrar pareja. Mendivil Tech no es responsable de la conducta de otros Usuarios, dentro o fuera de la App, en la medida en que la ley lo permita.

10. Cambios a estos términos

Si Mendivil Tech cambia estos términos, lo avisará en la App y pedirá al Usuario aceptarlos de nuevo antes de seguir usándola.

11. Ley aplicable y jurisdicción

Estos términos se rigen por las leyes de los Estados Unidos Mexicanos. Cualquier controversia se resolverá ante los tribunales competentes de Ciudad Juárez, Chihuahua.

Nada de lo anterior limita los derechos que las leyes de protección al consumidor otorgan al Usuario y que no pueden renunciarse: en México, ante la Procuraduría Federal del Consumidor (PROFECO); en Estados Unidos, conforme a las leyes de su estado de residencia.

1. Acceptance and definitions

These terms govern the use of the Vamos Por Un Café application (the "App"), operated by Mendivil Tech ("Mendivil Tech" or "the team"). "User" means any person who creates an account or uses the App.

By creating an account, the User accepts these terms, the Privacy notice and the Child safety standards. Anyone who does not agree must not use the App.

2. Requirements to use the App

• The User must be 18 years of age or older.
• The User must register with real information, such as their name, date of birth and their own photos.
• Each person may have only one account, for personal use, which may not be shared, sold or transferred.
• Anyone whose account was removed for breaking these terms may not create a new account.

3. Community guidelines

To keep the App a safe and respectful space, the following is not allowed:

• Any form of child sexual exploitation or abuse (see the Child safety standards). It leads to immediate removal and a report to the authorities.
• Posting nudity or sexually explicit content on the profile, or sending such content to someone who did not ask for it.
• Harassing, threatening, insulting or intimidating other people.
• Impersonating another person or using photos that are not one's own.
• Asking for money or promoting businesses, scams, investment schemes or sexual services.
• Posting content that promotes hatred or violence based on origin, gender, orientation, religion, disability or any other condition.
• Using the App for any illegal activity.
• Trying to access other Users' data, automating the App or interfering with how it works.
• Creating fake accounts or using other people's accounts, including to obtain rewards or benefits.

4. User content

The User keeps ownership of the photos and text they post. By uploading them, the User authorizes Mendivil Tech to store them and show them to other Users within the App, solely to operate the service. This authorization ends when the User deletes the content or their account, except for what must be kept because of a report, as described in the Privacy notice.

Each User is responsible for what they post and what they write in their conversations.

5. Reports, moderation and sanctions

• Any User may report another from their profile, a photo or a conversation. Reporting someone also blocks them.
• For harassment, threats, scams, impersonation and any other serious conduct, the User may also write to [email protected]. Cases involving minors are handled with urgent priority.
• A member of the team reviews every report. While a serious report is under review, the team may hide a photo or an account as a precaution.
• Depending on the severity, the team may take no action, send a warning, remove a photo, suspend the account for a period of time or permanently remove it.
• In cases of a possible crime, the team will keep the evidence and may hand it over to the authorities.
• Bad-faith reports: if it is proven that a User knowingly made a false report to harm another person, they may be sanctioned with a suspension or the removal of their account.
• Appeals: a sanctioned User may appeal from within the App, on the screen of their suspended or removed account, or by writing to [email protected] from their account's email. The team will respond within 10 business days at most.

6. User safety

Mendivil Tech does not verify the identity or background of Users. We recommend being careful when sharing personal information and, when meeting someone in person, doing so in a public place and letting someone you trust know. If someone makes the User feel unsafe, the User should report and block them.

7. Premium and founding members

Premium

• Premium is an optional monthly subscription. The App can be used without paying.
• It includes: unlimited coffee invitations, seeing everyone who liked the User, seeing people less than 20 km away and choosing the search distance (from 1 to 100 km), viewing the full profile of their matches again from the chat, and using the App without ads. Mendivil Tech may add benefits; if it removes any, it will give notice beforehand.
• Price: in Mexico, $199.99 MXN per month, VAT included. In the United States, 14.99 USD per month, plus any applicable state sales tax, which the store calculates and charges at the time of payment. In other countries, the price is shown in the store before paying.
• Billing and renewal: payment is made through Google Play or the App Store, with the payment method the User has registered in the store. The subscription renews automatically every month until the User cancels it from the store's subscriptions section. After cancelling, the User keeps Premium until the end of the paid period. Refunds follow the store's rules and applicable law.
• Price changes: Mendivil Tech will give notice before any price change, and the store will ask for the User's confirmation when the law or its rules require it.

Founding members

• A limited number of the first people who complete their registration receive a founder number. That number is personal and is not shown to other Users; others only see the "Founder" badge, and only if the User chooses to show it.
• Founder mission: claiming the badge opens a mission. If the User invites with their code the number of friends indicated in the App (currently 10), they get a lifetime 50% discount on Premium. All friends invited since the User's registration count, as long as they complete their profile with a photo and are real people. The mission can only be completed while it is active; anyone who has already completed it keeps their discount even if the mission closes.
• Lifetime 50% discount: whoever completes the mission will pay half of the regular Premium price in their country. Currently that is $99.99 MXN per month, VAT included, in Mexico and 7.49 USD per month, plus taxes, in the United States. If the regular price changes, their price will remain half of the new one.
• "Lifetime" means for as long as the User's account exists and Mendivil Tech offers Premium. The benefit is personal and may not be transferred, sold or assigned. It is lost if the User deletes their account (a new account does not recover the number) or if their account is removed for breaking these terms. While an account is suspended, its founder benefits are paused.
• Review and irregularities: the team reviews invitations. Any irregularity, such as creating fake accounts, using other people's accounts or paying for sign-ups, will cause the User to automatically lose the benefit and their founder badge, and may lead to the removal of their account.
• Founders will also have access to exclusive themes and features that Mendivil Tech may offer in the future. Which ones and when is decided by Mendivil Tech.
• End of the program: the founders program ends when all available spots are assigned or on the date Mendivil Tech announces in the App, whichever comes first. Mendivil Tech will give at least 7 days' notice to those who have not claimed their badge; badges not claimed before the end can no longer be claimed.

Invitations

• By inviting friends with their code, the User earns themes for their profile according to the number of friends who complete their registration.
• Once the founders program ends, whoever completes the invitation of 5 friends will also earn 1 free month of Premium, which starts counting when Premium becomes available.

8. Account deletion

The User may delete their account at any time from the App (Account information → Security → Sensitive actions) or without the App at vamosporcafe.com/eliminar-cuenta. What is deleted and what is kept is explained in the Privacy notice. Mendivil Tech may also close an account that does not follow these terms.

9. The service "as is"

The App is provided as is. Mendivil Tech does its best for it to work and be safe, but does not guarantee that it will be free of errors or that the User will find a partner. Mendivil Tech is not responsible for the conduct of other Users, inside or outside the App, to the extent permitted by law.

10. Changes to these terms

If Mendivil Tech changes these terms, it will give notice in the App and ask the User to accept them again before continuing to use it.

11. Governing law and jurisdiction

These terms are governed by the laws of the United Mexican States. Any dispute will be resolved before the competent courts of Ciudad Juárez, Chihuahua.

Nothing in these terms limits the rights that consumer protection laws grant the User and that cannot be waived: in Mexico, before the Federal Consumer Protection Agency (PROFECO); in the United States, under the laws of their state of residence.
